Donald Trump (President Elect of USA) Officially Sentenced in Hush-money Case

In a precedent-setting and rather disruptive legal conclusion, on January 10, 2025, President-elect Donald Trump was sentenced in the New York “hush-money” case. The sentence, entitled as “unconditional discharge”, does not subject the newly elected president to prison or restrictions only a few days before his swearing-in on January 20. “This is the only lawful sentence given the constitutional provisions within which the office of the president is encased,” Justice Juan Merchan, who is holding the case, stated. This has started a hot debate across both political and legal lines, making it the first time there has been a presidential sentence in the United States for a crime.

Unconditional Discharge Explained

This sentence follows Trump’s conviction for making hush-money payments to adult film actress Stormy Daniels during his 2016 presidential campaign. Although that conviction is not overturned, an “unconditional discharge” means that no other penalties will be imposed on the convicted man, such as fines, community service, or probation.

“This court has concluded that the only lawful sentence that allows entry of judgment of conviction without trampling upon the highest office of the land is a sentence of unconditional discharge,” Merchan said during the hearing.

The ex-U.S. attorney Barbara McQuade: “The case is over. The conviction stands and predicates nothing more. This is highly unusual but reinforces the extraordinary deference given to the office in legal terms.”

In response to the legal allegations that are overwhelming him-those that seem to blot out all else-Trump said virtually from his Mar-a-Lago home in Florida, but very strongly denied any wrongdoing. “This has been a very terrible experience, really,” he said, calling the case a politically motivated “weaponization of government” aimed to viciously smear him and undercut his presidency.

The Republican leader, clearly frustrated, renewed his intention to appeal the conviction, which he termed “a matter not at all deserving of the title.

Legal and Political Consequences

Judge Merchan stressed that the presidency itself was more at the heart of his decision to enter the unconditional discharge. “The great, indeed almost singular protection of the office of chief executive obliterates every other consideration. It does not reduce the seriousness of the crime nor can it ever justify itself,” he said.

The sentencing took place just a day after the U.S. Supreme Court, in a narrow 5-4 decision, rejected Trump’s legal team’s plea for postponement of the trial until after his inauguration.

In making his recommendation for an “unconditional discharges,” prosecutor Joshua Steinglass criticized Trump for doing so: “This defendant has caused lasting damage to the public perception of the criminal justice system,” said Steinglass, recognizing that such a behavior from Trump throughout trial is a “direct assault on the rule of law.”

He accused the office of the Manhattan District Attorney of bias toward politics: Todd Blanche, Trump’s attorney. “This is a case that without a doubt was brought by a district attorney who promised he would go after President Trump if elected,” Blanche argued, adding that the case was a “sad day for the country.”

Trump’s emphasis: Greenland and foreign policy

In spite of the legal issues, Trump has continuously made efforts to outline at least some of his priorities as president. Such an example happened a few hours before his sentencing when he held a press conference at Mar-a-Lago and addressed issues of possibly buying Greenland, which is an autonomous territory of Denmark.

In fact, he did not deny the military option on the periphery of the Danish nation and also sounded off to the Danes that they would face “very high” tariffs should they resist. This is coming after the visit made by his son, Donald Trump Jr. to Nuuk, the capital of Greenland, which added further curiosity on what the administration intends to do or not do.
